Flash Exchange Website Usage Policy

Last updated: 22.09.2025

1

General Provisions

1.1.
This Policy defines the terms of use of the Flash Exchange website (hereinafter referred to as the "Website") and the services provided through it.
1.2.
Flash Exchange is a platform for cryptocurrency exchange, international transfers and related financial operations.
1.3.
By using the Website, the User confirms that they have read and agree to this Policy, as well as the AML Policy, Refund Policy, Personal Data Policy (Privacy Policy), Cookie Policy and other public documents of the Service.
1.4.
Services are not provided to citizens, residents, or persons located or established in jurisdictions included in OFAC, EU, UN sanctions lists or FATF black/grey lists, as well as other persons subject to international sanctions or restrictions. The User warrants that they do not belong to such categories and are not included in any sanctions lists.
1.5.
The User warrants that they will use the Service exclusively for lawful purposes and in accordance with the applicable laws of their jurisdiction and the jurisdiction of the Service.
2

Terms of Service

2.1.
Services are provided to individuals aged 18 and over, and to legal entities.
2.2.
Flash Exchange reserves the right to set limits, fees, and order processing times depending on the exchange direction, risks, and available partners.
2.3.
Orders are accepted during working hours: daily from 11:00 to 19:00 (Moscow time). Processing outside these hours is possible exclusively by written agreement with support and is not a standard procedure.
2.4.
Services are provided only after confirmation of payment, provision of all necessary information, completion of AML verification if required, and successful verification of the provided data by the Service.
2.5.
The exchange rate is fixed only at the moment the Service receives the required number of network confirmations for the cryptocurrency transaction of the full amount, the full deposit of fiat funds to the Service account, or the receipt of the full amount of cash at the office. If by that moment the exchange rate (binance.com for cryptocurrency, forex.com for the ruble, xe.com for the euro and the dollar) changes by more than 0.1%, the calculation will be adjusted to the rate at the moment of fixation.
Required number of network confirmations per asset:
AssetConfirmations
Bitcoin (BTC)4
Ethereum (ETH)21
USDT (TRC-20, ERC-20)21
USDC (ERC-20)21
USDT, USDC (BEP-20)15
USDT (Solana)1
USDT (TON)1

The number of confirmations is a minimum condition for verifying a transaction, not a deadline for execution or payout. Processing takes place after the funds actually arrive and the required checks are completed, during the working hours of the Service. The timeframe may increase due to network conditions and additional checks.

2.6.
Transaction processing times indicated on the Website or in communications with support are approximate. Actual processing time depends on blockchain network load, banking systems, user-set fees, Service policies, and completion of required checks. Flash Exchange does not guarantee compliance with the indicated approximate timeframes.
2.7.
Flash Exchange reserves the right to refuse services, restrict functionality, block an account, or freeze User funds at any time without explanation, in particular upon suspicion of:
•violation of this Policy, AML Policy, or other Service rules;
•fraud, deception, attempts to circumvent security or control systems;
•provision of false, incomplete, or outdated data;
•use of the Service for illegal purposes (money laundering, terrorist financing, sanctions violations, etc.);
•technical hacking attempts, API abuse, or creating excessive load on the infrastructure;
•behavior threatening the security, stability, reputation of the Service, or the interests of other users;
•association with prohibited jurisdictions or sanctioned persons (clause 1.4).
In the event of such refusal/blocking, the Service obligations to fulfill current or future User orders are terminated.
3

User Warranties

3.1.
The User warrants and confirms that:
•they are the beneficial owner of all cryptocurrency wallets, bank accounts, and cards used;
•they have full legal authority to dispose of all funds involved in operations through the Service;
•the funds used in operations are of exclusively lawful origin and are not associated with any illegal activity;
•the data provided (including but not limited to: full name, date of birth, residential address, identity document details, selfie with document, source of funds for large amounts) is complete, accurate, current, and truthful at the time of submission;
•they have carefully verified all recipient details (crypto wallet, bank details) before confirming the order;
•they will not use the Service to circumvent applicable legislation;
•they bear full responsibility for compliance with the tax legislation of their country, including any income tax obligations arising from funds received in their account.
3.2.
The User undertakes to:
•provide accurate data (as defined in clause 3.1);
•not use the Service for money laundering, terrorist financing, or other illegal activities;
•not submit knowingly false orders;
•not transfer account credentials to third parties; the User bears responsibility for all actions performed under their account;
•immediately inform the Service of any changes to the provided data.
4

Liability of Parties

4.1.
Flash Exchange shall not be liable for:
•losses caused by sharp cryptocurrency exchange rate fluctuations;
•delays caused by technical failures in third-party platforms (banks, blockchain, payment systems);
•actions of third parties involved in the funds transfer process;
•losses caused by User errors in specifying recipient details (crypto wallet, bank details). Verifying details before confirming an order is the sole responsibility of the User;
•losses caused by compromise of the User account (login/password leak, phishing, viruses on the User device);
•losses caused by the User losing access to their cryptocurrency wallets (loss of private keys, seed phrase);
•failures or losses caused by the User actions (inaction), malfunction of their equipment or software;
•the User's failure to comply with payment requirements using the provided details, including cases where payment was made:
a) after the payment time set by the Service has expired;
b) using details that are no longer valid or were intended exclusively for a specific transaction.
4.2.
The User bears full responsibility for compliance with all warranties given in Section 3 and for the consequences of their violation.
5

Personal Data Processing

5.1.
Flash Exchange processes personal data in accordance with applicable legislation and its Privacy Policy.
5.2.
The User consents to the processing and storage of provided data, including IP address, email, phone number, wallet addresses, correspondence, transaction data, device information, activity history, and other information related to orders and use of the Service.
5.3.
Data is not shared with third parties, except as required by law, AML regulations, or as necessary for order fulfillment (e.g., payment processing or fund transfer partners, subject to confidentiality obligations).
5.4.
The Service uses cookies and similar technologies. Details are set forth in the separate Cookie Policy published on the Website.
6

Refunds and Order Cancellation

6.1.
Refunds are possible only at the discretion of the administration and only if the funds have not been transferred to the recipient according to the details provided by the User.
6.2.
Refunds are not possible if the funds have already been sent to the details specified by the User, even if those details were provided in error.
6.3.
To request a refund, contact the operator in the order chat or send an email to: info@flashexchange.io specifying the order number and reason.
6.4.
All refunds are made minus the network or bank fee and the direct costs of the refund. The network fee is the actual cost at the time of the transfer.
6.7.
If the User terminates an Order after transferring funds to the Service and before the deal is completed, the refund is made minus the direct costs of the refund and any losses of the Service — up to 5% of the exchange amount.
6.8.
A refund is processed within 72 hours of receiving the request. For transactions classified as high risk, the refund is processed within 14 calendar days of the User being notified of the decision.
6.9.
Funds are returned to the same details they arrived from. A refund to different details is possible only after the Service has verified them.
6.10.
A refund is not possible for an Order that has already been executed.
6.11.
If crypto assets are sent on the wrong network, or to a Service wallet outside an Order, the possibility of a refund is determined case by case. The Service may decline to return such funds.
6.5.
Flash Exchange reserves the right to refuse a refund in case of violation of service rules, provision of false data, failure to pass verification, non-compliance with warranties in clause 3, or upon suspicion of fraud, money laundering, or sanctions violations.
6.12.
When sending crypto assets, the User must provide, on request, proof of the transfer: the transaction ID (TXID) or a blockchain link. For bank transfers — a statement or receipt showing the time, the recipient details and the amount. Without such proof a non-standard payment cannot be reviewed.
6.6.
The payments listed below are not processed automatically and require manual review by an operator. The Service does not guarantee a timeframe for such review, and in some cases a refund is technically impossible:
•an amount different from the one specified in the Order is transferred — the Service recalculates by the amount actually received. If the difference exceeds 10%, the Order terms may be terminated and the funds returned minus refund costs;
•the transfer is made to details not stated in the order — for example, to a different bank or on a different network. A transfer sent on the wrong network cannot be recovered;
•the transfer arrives after the payment window has expired — such funds are returned to the User minus refund costs. If the User asks to continue the exchange, the Service may change the rate and the terms of the Order;
•the confirming receipt/screenshot/document is not uploaded on time or in the required format;
•funds arrive from an address or account other than the one stated by the User in the order — that address is checked separately. A payment from a third party is not accepted and is returned to the sender minus the network fee.

AML Policy

7.1.
Flash Exchange strictly follows "Know Your Customer" (KYC) principles and anti-money laundering/counter-terrorist financing (AML/CFT) practices. The Service is obligated to freeze funds and/or suspend operations upon detection of suspicious activity or compliance with criteria established by AML policy and legislation.

•suspend the exchange operation;
•request video identification;
•offer the User to contact support online (video call/chat);
•request additional information and/or documents confirming the source of funds and circumstances of the operation.
If concerns are confirmed, the operation may remain suspended and the funds may be temporarily held until the review is completed. Completion of the operation or return of funds is governed by the full AML/KYC Policy and applicable restrictions.
